India strengthens E-Cigarette ban enforcement to protect public health
In a significant move to safeguard public health, the Union Health Ministry of India has intensified its efforts to enforce the Prohibition of Electronic Cigarette Act (PECA) 2019.
Official sources have confirmed that the Ministry sent a clarifying message to the Ministry of Civil Aviation (MCA) last month, aiming to bolster the implementation of the e-cigarette ban.
The clarifications emphasize that possession of e-cigarettes in any form, quantity, or manner within the country directly violates PECA 2019.
The Deputy Secretary at the Ministry of Health highlighted that while the Act does not explicitly mention individual use, it comprehensively prohibits e-cigarettes.
The prohibition includes the production, manufacture, import, export, transport, sale, distribution, storage, and advertisement of e-cigarettes.
This sweeping ban extends to encompass all forms of Electronic Nicotine Delivery Systems, e-Hookah, and similar devices.
The primary objective behind the law’s enactment is to protect the well-being of the people and public health.
Despite the imposition of heavy penalties and imprisonment, e-cigarettes have remained disturbingly accessible through various sources, including tobacco vendors, general stores, and online suppliers.
To bolster enforcement, the Health Ministry has launched an online portal for reporting PECA violations.
This new portal enables individuals to report violations easily, allowing the Ministry to take prompt action against offenders.
Of great concern to the government is the alarming surge in e-cigarette use among the youth, making stringent enforcement even more imperative.
In a series of measures to reinforce the ban, the Ministry issued a public notice in May, followed by notices sent to 15 websites in July. It urged them to cease advertising and selling e-cigarette products.
Furthermore, in February, the Ministry communicated with all states and Union territories, asking them to ensure effective compliance with the ban.
The Ministry had previously highlighted the sale of e-cigarettes at stationery stores near educational institutions, signaling the need for immediate action.
The Union Health Ministry’s unwavering commitment to enforcing the e-cigarette ban underscores its dedication to protecting the public from the potential harm associated with these products.
With a comprehensive legal framework in place and a new reporting portal at their disposal, authorities are poised to crack down on violators and curb the proliferation of e-cigarettes in the country.
