Rs.1.8 crore compensation for baby blinded by medical negligence

The Supreme Court on Wednesday has ordered a 36-fold increase in compensation by the Tamil Nadu government and a state-owned hospital at Egmore in Chennai. The government was ordered to pay Rs.1.80 crore to the parents of a toddler who had lost her seeing before even reaching the age of one year eighteen years past. It was caused because of the negligence of doctors.

The child was born ten weeks prematurely to V Krishnakumar and his wife in August 1996 at the government hospital for women and children. The mistake happened when the prenatal expert and therefore the paediatrician at the hospital never warned the parents that babies who are born prematurely are likely to get retinopathy of prematurity (RoP). This can lead to blindness if early preventive measures weren’t taken.

Within a year of birth, the kid was on the verge of losing her eyesight as RoP stage-V, the final stage before total blindness.

The parents were frightened and they received the suggestion of going to the United States for surgery.


In October 1997, the kid underwent four eye surgeries in a span of 2 months. However her sight in her eyes couldn’t be repaired, that had gone out thanks to medical negligence at the government hospital at the time of her birth.

The compensation was offered by the Supreme Court now after 18 years.

    It is a good judgment. It will aware the general mass. Public have the right to know about the rule related to medical negligence. Our Law are perfect but general public is unknown, Public should be aware about Medical Negligence’s rule & Law . Govt of India should make publicity in common mass for awareness.
