Zomato and Pune eatery fined ₹55,000

The frauds are growing in the country and so are the complaints. The popular eateries rather than trying to improve the quality and customer care, are behaving carelessly towards their customers.

They are ending with heavy fines if the customer is strong enough to fight against them.

Shanmukh Deshmukh is a lawyer who practices at Nagpur bench of the Bombay High Court. He had been to Pune in the last week of May due to some work.

He was fasting on the day and ordered paneer butter masala in the evening to break the fast from the restaurant in Hinjewadi through the Zomato app.


But, he was delivered butter chicken and he ate it a bit without knowing. After that, he complained to the Zomato delivery boy and the hotel for sending him the wrong dish.

They again sent him the wrong dish, i.e., butter chicken.

The lawyer then sent notices to Zomato and the restaurant for hurting his religious sentiments.

But, they did not care about these notices which led to filing a case in the consumer court for a compensation of ₹5 lakh and ₹1 lakh.

He produced his conversation recording as evidence. Zomato told the forum that the money had been refunded to the lawyer and his intention was to defame the company.

It also argued that sending a correct dish is the responsibility of the restaurant. Yet, the restaurant admitted its mistake.

The court slapped both Zomato and hotel with a fine of ₹55,000 – ₹50,000 for deficiency in service and ₹5,000 for mental harassment.

Earlier also there was an incident where the Zomato delivery boy opened the order and ate from it and delivered after sealing it back. This led to a big controversy as the video went viral and Zomato sacked the person.

It seems that if any incident comes into the light, the companies take action, otherwise, they don’t care about their customers.

Hence, customers should beware of the services they are getting even from the reputed companies.
