Madras HC bans online medicine sale | Fusion - WeRIndia

As the Delhi High Court restrains the online sale of medicines, now the Madras High Court also banned the sale of medicines online.

The Madras High Court on Monday stated that the online sale of medicines will be banned until the Union Health Ministry and the Central Drugs Standard Control Organization issues notifications on this.

As per the existing Drugs and Cosmetics Act, online sale of medicines is not permitted. In this context, several medical associations are claiming that those who sell online medicines violate the rules.

The Centre in this scenario proposed some amendments. The HC asked the government to issue a notification on the proposed changes to the Act before January 31, 2019.

The medical associations are alleging that most of the online pharmacy traders are selling medicines online without license which means it is illegal.

In this context, Justice Pushpa Sathyanarayana directed online pharmacy traders to get licenses according to the prescribed rules. The new rules will be notified within two months.

He added that online sale of prescription of drugs is difficult to be controlled when there are no Central or State government rules.

He expressed his dissatisfaction as the rules are still at the draft stage despite two years of time passing. He urged the government to look into the matter soon as enough time was given to it.

The order passed by the Judge on the ban of online sale of medicines is followed by the petition of the Tamil Nadu Chemists and Druggists Organization.

The Delhi High Court earlier on December 13 stayed the sale of drugs by e-pharmacies. The Judges of the Delhi HC passed an interim order on a plea which sought the ban on the sale of medicines online.

The Madras High court also passed an interim order on October 31 barring the sale of medicines online by unauthorized traders.
