Centre to implement equal pay for equal work soon
The central government is mulling to implement equal pay for equal work soon for all casual workers who are engaged by the government and its PSUs.
The Supreme Court judgment mandated the implementation of equal pay for equal work law and the Delhi High Court had sought the central government’s response on this.
Hence, the government asked all ministries, departments and PSUs to take further action on the order related to ‘Equal Pay for Equal Work’ for casual workers.
The Department of Personnel and Training directed all the ministries and departments to submit the action on this matter.
As per the OM issued on 07.06.1988, the following are to be considered while making payments to contractual workers.
If the nature of the work assigned to the casual workers and regular employees is the same, then, the casual workers should be paid the minimum wage along with the dearness allowance for the work of 8 hours a day.
The Minimum Wages Act, 1948 states that casual workers may be paid the minimum wages if the work of casual workers is different from those of the employees. These wages should be higher in both that are notified by the Ministry of Labour & Employment or the State Government/Union Territory Administration.
The casual workers should not be recruited on daily wages for regular work.
As per this order, all employees including contractual and temporary employees working under central government or PSUs shall be entitled to get a minimum basic salary plus dearness allowance like a permanent employee.
In March 2019, the Delhi High Court had directed the government to file the report on whether the government departments are complying with the law.
Now, the government has directed all its departments to submit a report on it.
