Women’s reservation law takes effect, but seats still years away

India has formally activated a landmark reform aimed at improving women’s political representation.

The Women’s Reservation Act 2023 has now come into force, following a notification by the Union Law Ministry.

Passed during a special session of the Parliament of India in 2023, the law, popularly known as Nari Shakti Vandan Adhiniyam, reserves 33% of seats in the Lok Sabha and state Assemblies for women.

However, its implementation is delayed, as it depends on delimitation after the next census, pushing actual rollout several years into the future.


Although the law is now legally active, it cannot yet be applied to the current Lok Sabha. This is because the reservation depends on a fresh delimitation process.

In simple terms, constituencies must be redrawn based on updated population data before seats can be reserved.

This process is tied to the next national census, expected after 2027. Only after this exercise is completed can reserved seats be allocated.

As a result, the quota may not take effect until the 2029 general elections, or even later under the original framework.

Interestingly, the government is currently debating amendments to speed up implementation.

The goal is to make the quota operational by 2029 instead of waiting until around 2034, as initially expected.

Officials have described the timing of the notification as a technical step. While it brings the law into force on paper, it does not immediately change representation in legislatures.

Despite the delay, the move marks a significant milestone. It lays the legal foundation for greater gender inclusion in Indian politics.

Once implemented, the reform is expected to reshape representation at both the national and state levels.

For now, the law reflects intent rather than immediate change. Its real impact depends on how quickly the census is conducted and the delimitation process is completed across constituencies.
