Plea for Governor's rule in J&K to be heard in SC

The Supreme Court has agreed to hear a plea which is seeking imposition of Governor’s rule in Jammu & Kashmir. The plea is based on a provision of J&K Constitution. Considering the situation in J&K, the plea is made.

The petition is filed by Jammu and Kashmir National Panthers Party (JKNPP). A bench headed by Chief Justice T S Thakur directed that the petition will be listed next week.

The counsel of JKNPP made the plea before the bench. They talked about how the Jammu and Kashmir has been under siege of the security forces and the police for the past two weeks. They said that the state is in total chaos, anarchy and disorder. They appealed for Governor’s rule to control the situation.

The counsel said that Governor’s rule under section 92 of the Constitution of Jammu & Kashmir should be used now. According to the petition, the counsel asked a direction to the Governor to dissolve the assembly of Jammu & Kashmir which failed to discharge its duties and functions.


The bench hearing this plea also comprises of justices FML Kalifulla and A M Khanwilkar. They asked the petitioners why they did not go for the Jammu and Kashmir high court to which the counsel replied that the Jammu and Kashmir high court has been locked up as well and there is nowhere else to go.

The petitioners said that people in Jammu and Kashmir are suffering a lot due to the chaos in the valley. The petition said that there is even rule of the gun and said that people in the Valley have no access to even basic necessities like water or medical stores.

The plea asked for the direction to Governor of Jammu and Kashmir to intervene under section 92 of the Constitution of Jammu and Kashmir. This lets the governor take over administration in the state to uphold security, safety and fundamental rights of citizens.
