Bill amending salaries of Judges

In order to bring uniformity in pensions and other service conditions of judges of High Courts and Supreme Court, a bill has been passed by Lok Sabha. The bill has amended the law on salaries and services of Supreme Court.

Law Minister D.V. Sadananda Gowda stated that the amendment bill was not brought in under any pressure from anybody. He added that all the suggestions made by different members were well considered while making the High Court and the Supreme Court Judges (Salaries and Conditions of Service) Amendment Bill, 2015.

Unlike what some members have alleged, he said that this legislature was not brought on by the demand of the Supreme Court. Some members have made claims that the government failed to keep up the dominance of the parliament, however those claims were dismissed.

Gowda stated that the bill was brought in under Article 175 to make sure that there will be no discrimination in the salaries, pensions and other services of the judges. He also said that the government has no other proposal to increase the salaries or pensions of the judges. He said that the Seventh Central Pay Commission recommendations would take care of the salaries and pensions.

Regarding the matter of having Supreme Court benches in other parts of the country, Gowda stated that many MPs have talked to him about it and that there was no proper proposal made in this direction. He said that no action will be taken unless the issue is initiated by Chief Justice of the High Court and Chief Minister of the concerned state.

Regarding the Supreme Court striking down the National Judicial Appointments Commission (NJAC) Act, 2014, the minister said how the judges will be appointed is being considered as the collegium system of appointment was once again declared as operational.
